Terms of Service

1. Service Description

GenerAIted ("the Service") is an AI-powered image and video generation platform. You provide text prompts and the Service returns generated media using third-party AI models.

2. Acceptance of Terms

By accessing or using the Service you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you may not use the Service.

3. Account & Authentication

You authenticate via a blockchain wallet. You are responsible for maintaining the security of your wallet and any activity that occurs under your account.

4. Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

5. Image Storage & Data Retention

Generated images may be stored on our servers as a convenience feature. Storage is not a backup or archival service. Generated content is currently stored indefinitely, but this policy is non-binding and may change at any time without notice.

We are not liable for loss, corruption, or unavailability of any generated content. You are solely responsible for downloading and retaining copies of any images or videos you wish to keep.

6. Right to Change the Service

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including but not limited to storage limits, retention periods, pricing, available features, and supported AI models. We will make reasonable efforts to notify you of material changes but are not obligated to do so.

7. Purchases & Credits

All credit purchases are final and non-refundable. Credits have no cash value and cannot be exchanged, transferred, or redeemed for currency.

8. Intellectual Property

You retain all rights to the text prompts you submit. Generated images and videos are subject to the terms and licensing of the underlying AI model providers. We make no guarantees regarding intellectual property rights in generated content and you use such content at your own risk.

9. Acceptable Use

You agree not to use the Service to:

  • Generate illegal, harmful, or abusive content
  • Infringe upon the rights of others
  • Attempt to circumvent usage limits or security measures
  • Resell or redistribute the Service without authorization

10. Content Safety & Moderation

All generations are processed through automated safety filters provided by our third-party AI model providers. These filters may block prompts that contain or are interpreted as containing:

  • Sexually explicit or NSFW content
  • Extreme violence or gore
  • Content promoting self-harm
  • Hate speech or content promoting illegal acts
  • Content depicting real individuals without consent

Credits are not refunded when a prompt is blocked by safety filters. Safety filters are applied by the underlying AI model providers and GenerAIted does not control their behavior. False positives may occur.

11. Account Termination

We may suspend or terminate your account at any time for violation of these Terms or for any conduct that we determine, in our sole discretion, to be harmful to the Service or other users.

12. Data Protection & GDPR

We process personal data in accordance with applicable data protection laws. You have the right to:

  • Request access to your personal data
  • Request deletion of your personal data
  • Export your data (data portability) — you can download your generated images at any time
  • Object to processing of your personal data

The legal basis for processing is the performance of a contract (these Terms) and your consent where applicable. To exercise any of these rights, contact us at the email address provided on our website.

13. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall GenerAIted, its operators, affiliates, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, use, or goodwill, however caused, whether in contract, tort, or otherwise, even if advised of the possibility of such damages. Our total aggregate liability shall not exceed the amount you have paid to us in the twelve (12) months preceding the claim.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the version number and effective date. Continued use of the Service after changes constitutes acceptance of the updated Terms. For material changes, we may require you to re-accept the Terms before continuing to use the Service.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable member state in which the operator is established, without regard to conflict of law principles.
